Terms and conditions
General terms for building cleaning and services provided by Jawad Gebäudeservice GmbH. Updated: 22 September 2026.
1. Contracting party and scope
Jawad Gebäudeservice GmbH, Jahnstraße 18, 59439 Holzwickede, Germany, represented by managing director Ahmed Jawad, registered at Amtsgericht Unna under HRB 11979, is your contracting party. These terms apply to agreed cleaning, caretaker, gardening, winter maintenance, renovation and other building services for business customers and consumers, provided they have been validly incorporated into the contract. Individual agreements take precedence. Mandatory consumer rights remain unaffected.
2. Quotes and contract formation
The services described on this website invite requests for a quote. The contact form does not itself place a chargeable order, and an acknowledgement is not acceptance of a contract. A contract is formed when the parties agree on the service and price and an offer is accepted. Any binding acceptance period stated in the quote applies. These terms are made available before the contract is concluded and apply only if validly incorporated.
3. Scope and additional services
The quote or order agreement defines the type and scope of work, property, areas, cleaning methods, frequency and special requirements. A particular result is owed where agreed or required by the type of contract. Additional services and changes, including their price, require agreement. Chargeable services will not be extended unilaterally. Where work is technically unsuitable or unsafe, an appropriate solution will be agreed before it is performed.
4. Appointments and obstacles
Agreed dates and deadlines must be observed. The parties notify each other promptly of foreseeable delays and agree how to proceed. Dangerous weather or other obstacles require safe performance to be clarified; statutory rights concerning delay, impossibility or breach remain unaffected. Please notify us early if an appointment cannot take place. Cancellation within 24 hours does not automatically result in the full fee becoming payable. Any claims depend on the valid agreement and the law; expenses saved and alternative earnings are credited where required.
5. Cooperation and keys
Customers provide the agreed safe access and necessary information, particularly about sensitive materials, existing damage and hazards. Water and electricity are provided at the property where agreed and needed. Keys and access devices are used only for the agreed purpose, protected against unauthorised access and returned when no longer needed. The parties notify each other of obstacles or damage as promptly as possible. Statutory claims are not excluded solely because immediate notification was omitted.
6. Prices, invoices and payment
The agreed price applies. Consumers are quoted total prices including statutory VAT and agreed incidental costs; if the total cannot be determined in advance, the calculation method is explained before the contract is concluded. Additional charges require a valid agreement. Payment and invoicing follow the agreed due dates or, otherwise, statutory rules. Default and its consequences are governed by law. Statutory rights of set-off and retention remain unaffected.
7. Defects and acceptance
Please report concerns with details of the property and affected service so that we can investigate and, where appropriate, remedy the issue. Where German law on contracts for work applies, acceptance, rectification, price reduction, withdrawal from the contract, self-remedy and damages follow the statutory conditions. Other services are governed by the relevant statutory performance and liability rules. These terms do not shorten statutory defect rights or limitation periods.
8. Liability
We are liable under the statutory provisions. This includes intent and negligence, injury to life, body or health, property damage and financial loss, and fault attributable to our legal representatives and persons used to perform our obligations. These terms contain no general exclusion of indirect damage or restriction of mandatory liability.
9. Duration and termination
Duration and ordinary termination follow the valid contractual agreement or, otherwise, the statutory provisions for the relevant contract type. These terms create no automatic renewal or minimum term. Statutory termination rights, particularly for good cause and under contracts for work, remain unaffected. Notices may be sent to our postal or email address; text form is sufficient unless a stricter form is required by law. Final billing follows the statutory conditions, taking account of services performed and savings that must be credited.
10. Consumers and withdrawal
Consumers may have a statutory right of withdrawal for distance contracts or contracts concluded away from our business premises. Instructions, contact details and information on exercising that right are available under “Withdrawal”. Starting work before the withdrawal period ends requires the express declaration prescribed by law; accepting these terms does not replace it. Merely requesting an appointment through the website does not conclude a chargeable contract.
11. Privacy
Our privacy policy explains personal-data processing, contact options and your rights. Consent to optional web analytics or advertising is not a condition for placing an order.
12. Final provisions
German law applies. Consumers retain the protection of mandatory provisions in their country of habitual residence where applicable under conflict-of-law rules. Court jurisdiction follows the law; no exclusive venue to the detriment of consumers is agreed. If a clause is invalid, the statutory provisions replace it, and the remainder of the contract remains effective as provided by law.
